Terms of Service

These terms ("Terms") govern your use of BrandShots ("the Service"), operated by Baruzo Tech. By signing in or using the Service, you agree to these Terms. If you don't agree, don't use the Service.

1. The Service

BrandShots generates AI-produced product photography, social posts, ad creatives, and ad copy from product images you upload. Each generation deducts credits from your account balance. Plans, pricing, and credit allocations are listed on the pricing page.

We may change features, prompts, or model providers at any time as long as the core service (turning a product image into ready-to-use creatives) remains intact.

2. Your account

• You must be at least 16 years old to use BrandShots.
• One account per person. Don't share credentials.
• You are responsible for everything that happens under your account.
• Sign in via Google OAuth — we don't store passwords.

We may suspend or terminate your account if you violate these Terms. We'll give you reasonable notice and refund unused prepaid credits, except where immediate termination is appropriate (e.g., abuse, fraud, prohibited content).

3. AI-generated content — important things you must understand

BrandShots produces output using third-party AI models. You must read and accept the following before using the Service.

3.1 Outputs are AI-generated and may be wrong

The Service uses generative AI. Output may contain visual artifacts, factual inaccuracies, misspelled or fabricated text, distorted product details, anachronistic elements, unintended visual references to real people or real branded products, or other defects. AI models can hallucinate text, claims, statistics, certifications, awards, ratings, or features that don't exist.

You are responsible for reviewing every output before you publish, print, ship, or otherwise use it. BrandShots is not a substitute for editorial or legal review.

3.2 No guarantee of accuracy, quality, or fitness

We make no representation or warranty that:

• Generated images will accurately represent your product, your brand, your audience, or any place, person, or item depicted.
• Generated copy will be factually correct, legally compliant, or appropriate for any specific channel, jurisdiction, or audience.
• Outputs will be free of unintended similarity to existing copyrighted, trademarked, or otherwise protected works.
• The Service will produce a usable result on any specific request, or any specific number of attempts.

The Service is provided "as is" and "as available" without warranties of any kind, express or implied, to the maximum extent permitted by law.

3.3 You are responsible for what you publish

When you use a generated output in the world (in an ad, on a marketplace, on social media, on packaging, in print, etc.), you become the publisher of that content. You — not Baruzo Tech — are responsible for:

• Verifying that any text in the image (claims, prices, certifications, statistics, ratings, etc.) is factually true.
• Ensuring the output does not infringe any third party's trademark, copyright, right of publicity, or other rights.
• Ensuring the output complies with the rules of the platform you publish to (Meta, Google Ads, Amazon, TikTok, Instagram, etc.).
• Ensuring the output complies with consumer-protection, advertising, and labeling laws of every jurisdiction in which it appears.
• Ensuring the output is not deceptive, defamatory, or harmful.

3.4 Prohibited use cases

You may not use BrandShots to generate content that:

• Depicts real, identifiable individuals without their consent (including celebrities, politicians, or public figures), or that suggests endorsement or association you don't have.
• Imitates the trade dress, packaging, or distinctive look of competing brands in a way likely to confuse consumers.
• Contains false claims about safety, efficacy, regulatory approval (FDA / CE / etc.), certifications, awards, ratings, customer counts, or third-party endorsements.
• Promotes regulated products (medical devices, drugs, financial securities, gambling, firearms, alcohol/tobacco where prohibited) without the regulatory review required in your jurisdiction.
• Targets children with marketing.
• Is sexually explicit, hateful, harassing, threatening, or otherwise illegal.
• Is intended to deceive (deepfakes, impersonation, fake news).

We may decline, filter, or remove generations that we believe violate these rules. Repeat or egregious violations may result in account termination without refund.

3.5 Indemnification

You agree to defend, indemnify, and hold harmless Baruzo Tech, its officers, employees, and contractors from any claim, demand, loss, liability, damages, fines, or legal fees arising from:

• Your use or publication of generated outputs.
• Your breach of these Terms.
• Content you upload that infringes third-party rights.
• Your failure to verify factual claims in published outputs.

This obligation survives termination of your account.

4. License to use outputs

If you are on a paid plan and your account is in good standing, you receive a non-exclusive, worldwide, perpetual license to use generated images and copy commercially, including ads, marketplace listings, social posts, printed marketing, and ecommerce product detail pages.

You may not:

• Resell raw generated images as stock photography.
• Sublicense the outputs to third parties as a generative service.
• Train a competing AI model on outputs.

If you're on the free tier, the same rules apply, but commercial use is limited to personal/test use. Switch to a paid plan before running paid ads or selling against generated images.

5. Acceptable uploads

You must own the rights to everything you upload, or have explicit permission. Don't upload:

• Images you don't have rights to.
• Photos containing recognizable people who haven't consented to AI processing.
• Images of minors.
• Product images of competitors that you don't represent.
• Anything illegal in your jurisdiction or in the United Arab Emirates.

We may delete uploads that violate these rules and may report serious violations to authorities.

6. Credits, billing, and refunds

• Credits are consumed per generation variant (1 credit = 1 image).
• Failed generations auto-refund the credit.
• Subscriptions renew monthly. Cancel anytime from settings; access continues through the end of the billing period.
• No partial refunds for unused credits in a finished billing period.
• Bug-related credit loss — email us within 14 days and we'll restore the credits.

Prices are in USD unless your invoice specifies another currency. Taxes are added per your billing address.

7. Service availability and changes

We try hard to keep the Service up but we do not guarantee uptime, response times, or any specific output speed.

We may temporarily route to alternate AI model providers during outages, quota issues, or pricing changes. Output style and quality may shift slightly during such transitions.

We may modify, suspend, or discontinue any part of the Service at any time. Material discontinuations will trigger an in-product notice and a 30-day window for affected users to export their data.

8. Limitation of liability

To the maximum extent permitted by law:

• Baruzo Tech is not liable for indirect, incidental, special, consequential, or punitive damages, including lost revenue, lost profits, lost data, regulatory fines, brand damage, takedown costs, or platform-policy violations resulting from your use of generated content.
• Our total aggregate liability for any claim related to the Service is limited to the fees you paid us in the 12 months preceding the claim, or USD $100, whichever is greater.

This limitation applies regardless of the legal theory of the claim (contract, tort, statute, etc.).

Some jurisdictions do not allow certain limitations of liability — in those, the limitations apply to the fullest extent permitted.

9. Changes to these Terms

We may update these Terms. Material changes (pricing structure, license scope, AI-content rules, dispute resolution) will trigger an in-product notice and a 30-day window for you to cancel before the change takes effect. Non-material changes (typo fixes, clarifications) take effect on publication.

Continued use of the Service after a material change indicates acceptance.

10. Governing law and disputes

These Terms are governed by the laws of the United Arab Emirates. Disputes will be resolved exclusively in the UAE courts unless we agree otherwise in writing.
